On January 24th, Fortify Rights, an international non-governmental organisation based in the United States, announced the filing of a criminal complaint in Germany. The criminal complaint, using the principle of universal jurisdiction, alleges perpetration of the crimes of genocide, war crimes, and crimes against humanity, by senior Myanmar military generals and others. Among the 16 victims who are participating in the matter, Fortify Rights has reported that half of the 16 individuals in its complaint were Rohingya, while the others were victims of post-coup atrocities in states and regions throughout the country in 2021 and 2022.
This recent filing now joins a wave of other cases that are pending. These matters include the International Court of Justice case, where The Gambia has brought a matter against the Government of Myanmar for a breach of its obligations under the UN Genocide Convention, the ongoing investigation by the International Criminal Court, and the criminal case in Argentina which also uses universal jurisdiction.
